NO to 16TAC - 401.305 & 401.312
NO to paying the advertised jackpot amount instead of a percentage of sales for the 6 of 6 winners. I believe all monies in the prize pool should be divided equally by the players who won the specific prize. A 6 of 6 winner should not receive a higher or lower percentage of sales than a previous winner or a future winner. All 6 of 6 winners should be paid the same percentage of sales.
I oppose the Commissions refusal to follow the rules.(E) (2) says, Prize pool. The prize pool for Lotto Texas prizes shall be a minimum of 55% of Lotto Texas sales. But the breakdown for each prize level is - 37.532% for 6 of 6 winners, 2.7885% for 5 of 6 winners, 6.8805 for 4 of 6 winners, and 6.699% for the 3 fo 6 winners yet this does not equal 55% of sales. In the first 105 drawings under 6/54, 3 of 6 winners collected $47,548,850 but $48,146,678 was in the prize pool. I think all prize monies in each prize pool should be divided equally by those who won - down to the penny. No carryovers, no rounding down.These same rules should apply for Texas 2 Step too.
NO to this language change: Texas 2 Step (i) the direct prize category contribution may [was shall] be 45.56% of the prize pool for the drawing. NO to the same statement in the Lotto Texas rule that uses the word may instead of shall as well. The rules for determing prize amounts should be set in stone and the TLC should follow them to a T.
NO to the language in the Lotto Texas rule that says the direct prize category contribution may be 68.24% of the prize pool AND 5.07% of the prize pool AND 12.51% of the prize pool AND 12.18% of the prize pool . I feel the TLC uses these figures as a way to confuse the general public. The percentages quoted here refer to taking that percentage from 55% of total sales. The TLC should reference the percentage from total sales and make it simpler for the people to understand. 37.532%, 2.7885%, 6.8805% and 6.699% of total sales is easier to comprehend. These figures dont sound as good - yet they are the true figures and one doesnt have to calculate twice to arrive at a figure.
I oppose the TLCs Refusal: (1) To accept phone calls for comment (2) to accept e-mails for comment (3) to issue press releases and/or buy ad space to make certain that the citizens of Texas are aware of the changes being proposed. The TLC promotes new games - you should promote rule changes too. Are you hiding something?

I want the unclaimed prize monies to be returned to the players. This money makes up the prize pools 50% or 55% - the minimum that SHALL be paid to the players. Losing $29 million between Aug. 2000 and July 2001 was grossly unfair to players.
I still oppose the addition of the 4 balls that were added to Lotto Texas in July 2000.
NO to 16TAC - 401.302 - Scratch Tickets
NO to deleting paragraph (k) Game Report. It states the TLC does NOT have to make public the End Of Scratch Game report to the public nor do you have to produce this report. I firmly believe we have a right to this information and it should be available if we request it.
I oppose not having access to the prize structures for scratch off tickets BEFORE I buy the ticket. Not disclosing how many scratch tickets were printed or how many prizes there are for each prize in the games is WRONG. I believe this information should be available at EVERY retail location.
I oppose this language - the director may approve and publish individual game procedures prior to each instant game being introduced for sale to the public. I believe prior to selling any scratch tickets, disclosure shall be mandatory when requested from a player. The rule should also specify when this data shall appear in the Texas Register.
